By using the New Mexico Caregivers Coalition’s Respite Care Registry (“Registry”), you agree to these Terms and Conditions of Use. IF YOU DO NOT AGREE WITH ALL OF THE LEGAL TERMS IN THESE TERMS AND CONDITIONS OF USE, YOU ARE EXPRESSLY PROHIBITED FROM ACCESSING OR USING THE RCAW REGISTRY.

The Registry is offered and available to users who are 13 years of age or older and reside in the United States or any of its territories. By using the Registry, you represent and warrant that you are of legal age.

Additionally, you agree by using and accessing the Registry that these Terms and Conditions are applicable to you.

Changes to the Terms and Conditions of Use:

New Mexico Caregivers Coalition may revise and update these Terms and Conditions of Use from time to time in our sole discretion. You waive any right to receive specific notice of revisions, updates, or changes. All revisions, updates, or changes are effective immediately when posted and applied to all use of the Registry thereafter.

Your continued use of the Registry following the posting of revised Terms and Conditions of Use means you accept and agree to the changes.

Registry Disclaimer:

The Registry is provided as a community service for informational purposes only. Joining our Registry as a provider does not create an employer/employee relationship, contractor/subcontractor, or any other contract or affiliation of any kind between a provider and New Mexico Caregivers Coalition.

Respite providers self-report all information they disclose. Listing within the Registry does not represent an endorsement, and providers not listed in the database does not constitute a lack of support.

By joining the Registry or searching for a provider on the Registry you agree to hold New Mexico Caregivers Coalition harmless, and indemnify New Mexico Caregivers Coalition, from any and all claims, causes of action, charges, fines, taxes, costs, or damages that arise from your use of the Registry from your communications with any person or your contracting to provide any services to any person.

New Mexico Caregivers Coalition reserves the right to refuse a provider’s request to be listed on the Registry or to remove a provider’s existing listing on the Registry for any reason not prohibited by prevailing law with or without cause. New Mexico Caregivers Coalition also reserves the right to refuse a post on the Registry or to remove an existing post for any reason not prohibited by prevailing law with or without cause. New Mexico Caregivers Coalition assumes no responsibility for any claims, causes of action, charges, fines, taxes, costs or damages arising from the use of the Registry and/or Respite Connections.

If you are using the Registry to search for a provider, you take responsibility for reviewing the experience, background checks and qualifications of any respite provider or agency that you may hire as the providers are self-reporting all information.

Prohibited Respite Providers:

Respite Providers are not allowed to use or be listed on the Registry if they are subject to any of the listed disqualifications:

  1. Been convicted of a felony in any jurisdiction, and/or have pending felony charges in any jurisdiction;
  2. Are a registered sex offender and have not been charged with any sex-related;
  3. Been adjudicated as incompetent or with a mental defect by a court of New Mexico;
  4. Not the subject of any abuse or domestic violence injunction or restraining order; or
  5. Not listed on the New Mexico Caregivers Criminal Background Check website, or any other similar registry in a different jurisdiction.

User Submissions:

You agree you will not upload or transmit any communications or content of any type to the Registry that infringes or violates any rights of any party. By submitting communications or content to the Registry, you agree that such submission is non-confidential for all purposes.

If you post content within the Registry, you are solely responsible for your own content, the consequences of posting said content and your reliance on any content found in the Registry.

In cases where you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately.

Monitoring and Enforcement; Termination:

We have the right to:

  1. Remove or refuse to post any Registry profile or any other User Submission with or without cause at our sole discretion.
